COMMERCIAL TERMS AND CONDITIONS

1. Introductory provisions
The operator of the e-shop is the Gallery of Fine Arts in Ostrava (Galerie výtvarného umění v Ostravě, příspěvková organizace), Poděbradova 1291/12, 702 00 Moravská Ostrava, Czech Republic, company ID no. (IČ): 00373231, VAT no. (DIČ): CZ00373231

2. Orders and purchases of items
The presentation of items on this website does not constitute a proposal for the conclusion of a contract of sale/purchase. The proposal for the conclusion of a contract of sale/purchase is the order placed by the customer for specific items and sent to the operator of the e-shop. After the receipt of the order, the customer receives an e-mail giving information confirming the receipt of the order; the order is then processed. The contract of sale/purchase is concluded at the moment when the customer receives an e-mail confirming that the order has been processed and the items have been prepared for dispatch.

The prices displayed in the e-shop are the currently valid final prices including VAT. Shipping costs are calculated separately depending on the shipping option selected.

The items remain the property of the e-shop operator until full payment has been received and the items have been delivered to the customer; the customer bears the risk of damage as soon as the items have been delivered to the customer.

3. Delivery and payment
Forms of payment:

Czech Republic:
Collection in person from the Gallery of Fine Arts shop at the House of Art, Ostrava: 0 CZK
Postal delivery by the Czech Post Office (Česká pošta): depending on the rates charged by the Czech Post Office (postage and packing costs). Items can be sent COD (cash on delivery).

Slovakia:
Postal delivery by the Czech Post Office (Česká pošta): depending on the rates charged by the Czech Post Office (postage and packing costs). It is not possible to send items COD (cash on delivery).

Other countries:
depending on the rates charged by the Czech Post Office (postage and packing costs)

Payment within the Czech Republic:
1.COD (cash on delivery): the full price (including shipping costs) is paid when the customer receives the items from the delivery operative or from the post office (cash payment)
2.Payment on collection from the Gallery of Fine Arts shop at the House of Art, Ostrava: cash or card payment
3.Bank transfer: the full price (including shipping costs) is paid by bank transfer from the customer’s account to the account of the Gallery of Fine Arts in Ostrava: Komerční banka, Moravská Ostrava, account no. 6532761/0100 (items are dispatched once the payment has been credited to this account)
4.Invoice payments: only for schools, libraries, state/regional/municipal institutions, companies; the ordered items are delivered to the customer along with the invoice
Where applicable, the order must contain the customer’s company ID no. (IČO), VAT no. (DIČ), the address for invoicing, and (if different) the address for delivery.

Payments send from abroad:
Payments must be sent using the IBAN: CZ6301000000000006532761, Swift code: KOMBCZPPXXX

Purchasing from abroad:
Books may be ordered direct from the e-shop or by sending an e-mail to info@gvuo.cz. When the order for books has been received, an e-mail will be sent to the customer containing a pro forma invoice stating the price of the items and shipping costs. The items are dispatched when the payment has been received.

Forms of shipping (Czech Post Office – Česká pošta):
1/ Priority transport
Delivery time: Europe 4 days, other countries 7 days
2/ Standard
Delivery time: Europe 4 days, other countries up to 90 days

4. Warranty conditions
Items purchased by a customer (consumer) are covered by the standard warranty conditions set out in the Czech Republic’s Civil Code. Items received may be returned to the e-shop operator within the legally stipulated period of 14 days. The items (accompanied by the order number) must be returned either in person or by post to the Gallery of Fine Arts at the following address: Galerie výtvarného umění v Ostravě, Poděbradova 1291/12, 702 00 Moravská Ostrava, Czech Republic, tel. +420 733 612 005. It is not possible to send the items to the e-shop operator COD (cash on delivery).

5. Conditions for claims
Claims for defective items may be submitted within 14 days of receipt of the items in the following ways:
1.by e-mail to info@gvuo.cz; inform us of your order number and give a description of the defects – send photographs if possible
2.by telephone: +420 733 612 005
3.by post to the address: Galerie výtvarného umění v Ostravě, Poděbradova 1291/12, 702 00 Moravská Ostrava, Czech Republic. If the claim
is accepted, it will be dealt with within 30 days from receipt of the defective item by replacing the item or by reimbursing the payment.

6. Personal data protection
The e-shop operator declares that all personal data are confidential, will be used solely for the purpose of the fulfilment of the contract with the customer and the marketing activities of the seller, will not be made public in any way and will not be provided to a third party etc. with the exception of situations connected with distribution or payment for the ordered items. Personal data provided voluntarily by the customer to the e-shop operator for the purpose of the fulfilment of the contract with the customer and the marketing activities of the seller are collected, processed and stored in accordance with Act no. 101/2000 Sb. on personal data protection, as amended and as currently valid. The customer grants the e-shop operator consent to collect and process these personal data for the purpose of the subject of the concluded contract of sale/purchase and for use in the marketing activities of the seller; this consent remains valid until the customer issues a written statement withdrawing the consent.

7. Final provisions
The contractual relations between the customer and the e-shop operator are governed by the Czech Republic’s Civil Code and Act no. 634/92 Sb. on consumer protection, as currently valid. These terms and conditions form a binding part of all contracts of sale/purchase concluded between the customer and the e-shop operator and implemented via this e-shop. By sending the order, the customer confirms that they have acquainted themselves properly with all commercial terms and conditions, that they have understood these terms and conditions, and that they accept these terms and conditions without reservations.

Consent to the processing of personal data
By completing the form on the gvuo.cz website, I consent to the processing of all personal data sent by me to the Gallery of Fine Arts in Ostrava (Galerie výtvarného umění v Ostravě, p. o.), Poděbradova 1291/12, Ostrava, Czech Republic, company ID no. (IČ) 00373231, listed as Pr 978 in the Commercial Register held at the Regional Court in Ostrava, i.e. the data administrator (hereunder “the company”) and with the subsequent processing of the data by the data processor for marketing purposes and the provision of commercial information via electronic communication as per Act no. 480/2004 Sb.; this consent remains in force until it is withdrawn.
